You can withdraw your declaration of willingness to enter into a contract within 30 days without stating any reasons, either in text form (e.g. letter, fax, e-mail) or by returning the item. The time limit commences no earlier than upon receipt of this information. To meet the time limit, it is sufficient if the notice of withdrawal or the item is sent before the limit expires. Consequences of withdrawal
In the event of valid withdrawal, the performance and consideration received by both sides must be returned and any emoluments taken must be surrendered. If you are unable to return the performance received in whole or in part or can only return it in worse condition, you may be obligated to compensate us for the relevant value. In case of provision of items, this does not apply if the deterioration of the item is attributable exclusively to the checking or inspection thereof in a manner that would have been possible for you in a store, for example. You can also avoid the obligation to provide compensation for value by refraining from using the item as your property and from taking any action that adversely affects its value. Items that are suitable for parcel shipping must be sent back. You are required to bear the costs of return shipping if the goods delivered are as ordered and the price of the item to be returned does not exceed EUR 40 or if the price of the item is higher and, at the time of the withdrawal, you have not yet rendered consideration therefor or remitted a contractually agreed partial payment. Otherwise, return shipping is free of charge to you. Items that are not suitable for parcel shipping will be picked up from you. You must fulfill obligations to refund payments within 30 days after sending your declaration of withdrawal.
Unless otherwise provided, the right of withdrawal does not exist in the case of contracts
1. for the supply of goods that were produced to customer specifications or are clearly tailored to personal needs or that, based on their specific quality, are not suitable for return shipment or can spoil quickly or whose expiration date has passed; 2. for the supply of audio or video recordings or of software, to the extent that the consumer has broken the seal on the data storage media supplied.
